The first recommendation has been followed. Article 36 (3) provides that a positive opinion of the competent (electoral) commission on the referendum question proposal is needed to submit a question to the referendum. The revised draft law does not foresee the consequences of a negative opinion, but the Serbian authorities informed the rapporteurs that it would be binding. Moreover, the scrutiny would take place after the collection of signatures if the referendum is requested by voters. In order to avoid a useless collection of signatures, the Venice Commission recommends giving the opinion on the question before such collection; it also recommends making the consequences of a negative opinion clear.
