As regards competence, it should be noted that the Constitutional Court in many countries is the organ responsible for ruling in general terms on appeals concerning referendums (Croatia, France – Constitutional Council –, Malta, Portugal). In Albania, it rules not only on constitutional matters, but also on the clarity of the question (where people are asked to vote on a generally-worded text) and, with regard to an abrogative referendum, on the autonomous nature of the law of which part is to be repealed. Portugal ’s reply states that a posteriori judicial control by the Court deals namely with the lawfulness of the campaign and the vote, as well as the sincerity of results.
