(1) A Member of the Folketing shall be entitled to a personal pension when the Member has, during one or more periods, been a Member of the Folketing for at least one year. The pension is paid from expiry of the period for which the basic fee has been paid if the relevant Member has at the time reached the state pension age, see section 1a of the Social Pensions Act (lov om social pension), and otherwise from the day when the Member reaches this age. In exceptional cases where health, financial or other social conditions so warrant, the Presidium of the Folketing may nevertheless decide to grant a former Member who has not reached the state pension age, see section 1a of the Social Pensions Act, a pension, the amount of which to be determined on a case-by-case basis. For purposes of decisions under the third sentence hereof, the Speaker of the Folketing may ask the National Board for Health Assessments in Cases against Civil Servants for a statement on a former Member’s incapacity for work on account of health conditions. The Committee for Rules of Procedure may lay down rules on criteria for the grant of pension under the third sentence hereof.
(2) The highest personal pension is obtained after 20 years of membership and amounts to 57 per cent of the grade 51salary (civil servants salary scale) in force at any time before deduction of the labour market contribution at the time of pensioning. The calculation percentage takes the number of membership years into account to mean that for membership years from 1 to 9 included each year contributes by 3.25 percentage point and for membership years from 10 to 17 included each year contributes by 2.80 percentage points, for membership years from 18 to 19 included each year contributes by 1.80 percentage points and for membership year 20 the year contributes by 1.75 percentage points. The rules governing the calculation of severance pay for civil servants shall apply correspondingly.
(3) A former Member of the Folketing may elect to receive payment of his or her personal pension under subsections (1) and (2) prior to the state pension age, but no earlier than from his or her pension payout age, see section 1a of the Pension Taxation Act (pensionsbeskatningsloven). In such case, a supplement will be paid until the Member reaches the state pension age, which supplement is, for each year, one-twentieth of the supplement payable from time to time under section 6(3) of the Civil Servant Pensions Act (tjenestemandspensionsloven). In case of payout less than two years after the pension payout age, however, the supplement will be only half such amount. Furthermore, an early retirement pension discount will be withdrawn permanently, see subsection (4).
(4) The early retirement pension discount shall constitute the following percentages of the pension under the first and second sentence of subsection (3), see subsections (1) and (2):
(i) For payout less than one year after the pension payout age: 17 per cent;
(ii) For payout after one year until two years after the pension payout age: 14 per cent;
(iii) For payout after two years until three years after the pension payout age: 6 per cent;
(iv) For payout after three years until five years after the pension payout age: 5 per cent;
(v) For payout after four years until five years after the pension payout age: 4 per cent;
(vi) For payout after five years until six years after the pension payout age: 3 per cent;
(vii) For payout after six years until seven years after the pension payout age: 1 per cent.
(5) A retired Member of the Folketing who resumes service as a Member of the Folketing, shall not receive a pension during the period for which a basic fee is paid. Neither is a pension payable in periods when the appropriate Member receives remuneration for his membership of the European Parliament.
