In light of the analysis contained in this chapter (IV.B.), the Venice Commission considers that either the mayors of the three metropolitan cities Diyarbakır, Mardin, and Van who had been suspended by decision of the Ministry of the Interior of 19 August 2019 should be reinstated or alternatively a different solution which respects the will of the voters should be adopted. One option in this regard would be to allow the respective municipal councils to choose a replacement mayor and another would be to arrange for repeat elections in the electoral zones concerned. The Commission also recommends the repeal of the amendments to Article 45, paragraph 1 of the Municipality Law which had first been introduced by Decree Law No. 674 and had been approved by Parliament in November 2016, thus restoring the capacity of the municipal councils to choose a replacement mayor in case the office of mayor falls vacant for any reason.
