Ciudad de México, a seis de julio de dos mil dieciséis.
VISTOS para resolver los autos del juicio de inconformidad promovido por el Partido Acción Nacional, a fin de controvertir los resultados consignados en el acta de cómputo distrital de la elección de diputados para integrar la Asamblea Constituyente, relativo al Consejo Distrital del Instituto Nacional Electoral correspondiente al Distrito Electoral Federal Dieciséis (16) de la Ciudad de México, con sede en Álvaro Obregón, y
RESULTANDO:
I. Antecedentes. De los hechos narrados y de las constancias que obran en el expediente se desprende lo siguiente:
a. El veintinueve de enero de dos mil dieciséis, se publicó en el Diario Oficial de la Federación el Decreto por el que se reforman y derogan diversas disposiciones de la Constitución Política de los Estados Unidos Mexicanos en materia política de la Ciudad de México.
b. El cuatro de febrero de dos mil dieciséis, el Consejo General del Instituto Nacional Electoral emitió la convocatoria para la elección de sesenta diputados para integrar la Asamblea Constituyente de la Ciudad de México. Dicho documento se publicó en el Diario Oficial de la Federación el día cinco de febrero de dos mil dieciséis.
c. El período de campaña corrió del dieciocho de abril al primero de junio del año en curso.
d. El cinco de junio de la presente anualidad, tuvo verificativo la jornada electoral.
e. El ocho del mismo mes y año, se efectuó la sesión de cómputo distrital de la elección en comento, respecto del Consejo Distrital del Instituto Nacional Electoral correspondiente al Distrito Electoral Federal Dieciséis (16) de la Ciudad de México, con sede en Álvaro Obregón, obteniéndose los siguientes resultados:

II. Juicio de inconformidad. En desacuerdo con los resultados consignados en la referida acta de cómputo distrital, el Partido Acción Nacional promovió juicio de inconformidad.
III. Trámite y remisión de expediente. Llevado a cabo el trámite respectivo, el Consejo Distrital del Instituto Nacional Electoral correspondiente al Distrito Electoral Federal Dieciséis (16) de la Ciudad de México, con sede en Álvaro Obregón, remitió el expediente formado a la Sala Regional de este Tribunal Electoral con sede en la aludida Ciudad de México.
IV. Tercero Interesado. Durante la sustanciación del juicio, compareció el Partido de la Revolución Democrática, en su calidad de tercero interesado.
V. Acuerdo de incompetencia. Por acuerdo de quince de junio del año en curso, dictado en el Cuaderno de Antecedentes 105/2016, el Magistrado Presidente de la aludida Sala Regional, sometió a consideración de este órgano jurisdiccional, el planteamiento de incompetencia para imponerse del asunto.
VI. Turno a Ponencia. Por proveído de quince de junio del año en curso, el Magistrado Presidente de esta Sala Superior acordó integrar el expediente respectivo, así como turnarlo a la ponencia de la Magistrada María del Carmen Alanis Figueroa, para los efectos previstos en el artículo 19, de la Ley General del Sistema de Medios de Impugnación en Materia Electoral.
VII. Radicación, admisión y cierre de instrucción. En su oportunidad, la Magistrada Instructora radicó, admitió y declaró cerrada la instrucción del asunto, quedando en estado de dictar sentencia, y
CONSIDERANDO:
PRIMERO. Jurisdicción y competencia. Esta Sala Superior del Tribunal Electoral del Poder Judicial de la Federación tiene jurisdicción y es competente para resolver el presente juicio de conformidad con los artículos 99, párrafo cuarto, fracción II, de la Constitución Política de los Estados Unidos Mexicanos; 189, de la Ley Orgánica del Poder Judicial de la Federación, y 51 y 52, de la Ley General del Sistema de Medios de Impugnación, atentos a la consideraciones que se esgrimieron en el Acuerdo General de la Sala Superior del Tribunal Electoral del Poder Judicial de la Federación número 2/2016, de veintiocho de junio de dos mil dieciséis, por el que asume competencia para conocer y resolver los medios de impugnación presentados contra los resultados de la elección de sesenta diputados para integrar la Asamblea Constituyente de la Ciudad de México.
SEGUNDO. Presupuestos procesales y requisitos de la demanda. El medio de impugnación reúne los requisitos previstos en los artículos 7; 8, párrafo 1; 9, párrafo 1; 51 y 52, de la Ley General del Sistema de Medios de Impugnación en Materia Electoral, de acuerdo con lo siguiente:
- Oportunidad. La demanda resulta oportuna, pues es el cómputo de la elección que nos ocupa concluyó el ocho de junio del año en curso, y la demanda se presentó el once siguiente, esto es dentro del plazo de cuatro días que previene el artículo 8, de la Ley General del Sistema de Medios de Impugnación en Materia Electoral.
- Legitimación. El juicio de inconformidad es promovido por parte legítima, conforme a lo previsto por el artículo 54, apartado 1, inciso a) de la ley en cita, porque lo acciona el Partido Acción Nacional, el cual es un instituto político con registro nacional, ante el Instituto Nacional Electoral.
Requisitos especiales de procedibilidad. Los requisitos previstos por el artículo 52, apartado 1 de la Ley General del Sistema de Medios de Impugnación en Materia Electoral también están reunidos, como se ve a continuación.
- Señalamiento de la elección que se impugna. Este requisito se reúne, porque el incoante señala en forma concreta que la elección que impugna es el cómputo distrital de la elección de diputados a la Asamblea de la Ciudad de México, relativo al Consejo Distrital del Instituto Nacional Electoral correspondiente al Distrito Electoral Federal Dieciséis (16) de la Ciudad de México, con sede en Álvaro Obregón.
- Mención individualizada del acta de cómputo distrital. En el juicio de inconformidad se precisa que el acto que se impugna es el resultado consignado en el acta de cómputo distrital de la elección de diputados a la Asamblea de la Ciudad de México antes referida.
- La mención individualizada de las casillas cuya votación se solicite sea anulada y la causal que se invoque para cada una de ellas. Este requisito se cumple, toda vez que el partido actor, como parte de su pretensión, identifica las casillas en las que demanda la nulidad de la votación recibida y señala la causal que, en su opinión, se actualiza.
TERCERO. Estudio de fondo. Del análisis del escrito de demanda signado por el partido inconforme, se desprende que sus alegaciones se encaminan a poner en evidencia que se actualiza la causal de nulidad de votación recibida en casilla, prevista en el artículo 75, apartado 1, inciso e), de la Ley General del Sistema de Medios de Impugnación en Materia Electoral, relacionada con recibir la votación personas u órganos distintos a los facultados, respecto a las casillas que a continuación se enuncian: 3163B, 3163C1, 3164B, 3164C1, 3165B, 3166B, 3166C1, 3167B, 3167C1, 3168B, 3169B, 3170B, 3171B, 3171C1, 3172C1, 3173B, 3173C1, 3174C1, 3175B, 3175C1, 3175C2, 3176B, 3176C1, 3176C3, 3176C4, 3179B, 3179C1, 3179C2, 3180B, 3180C1, 3181B, 3184B, 3185B, 3185C1, 3186C1, 3187B, 3188C1, 3189B, 3192C1, 3194C1, 3195B, 3195C1, 3195C2, 3196B, 3197B, 3197C1, 3198B, 3199B, 3200C1, 3202C1, 3204C1, 3208B, 3208C1, 3210B, 3212C1, 3212C2, 3213B, 3213C1, 3213C2, 3214C4, 3215B, 3216C1, 3239C1, 3240B, 3242B, 3242C2, 3243B, 3244B, 3244C1, 3245C2, 3246B, 3249C1, 3251B, 3254C2, 3251C1, 3258B, 3260C1, 3261C1, 3262B, 3262C1, 3264B, 3265B, 3267B, 3268B, 3268C1, 3269C2, 3272B, 3278C2, 3282B, 3282C1, 3283C1, 3284B, 3284C1, 3285C1, 3286B, 3286C3, 3287B, 3287C1, 3288C2, 3289B, 3289C2, 3290B, 3290C1, 3292B, 3296C1, 3297C2, 3301C2, 3314C1, 3330B, 3347B, 3347C1, 3351C2, 3477B, 3480C2, 3481B y 3481C2.
Antes de entrar al estudio de fondo de la cuestión planteada, resulta pertinente aclarar que, dentro del análisis de los diferentes supuestos relativos a las causales de nulidad de votación recibida en casilla, este órgano colegiado, tomará en cuenta el principio de conservación de los actos públicos válidamente celebrados que se recoge en el aforismo "lo útil no debe ser viciado por lo inútil", y el cual fue adoptado en la tesis de jurisprudencia 9/98, emitida por la Sala Superior del Tribunal Electoral del Poder Judicial de la Federación, cuyo rubro dice: “PRINCIPIO DE CONSERVACIÓN DE LOS ACTOS PÚBLICOS VÁLIDAMENTE CELEBRADOS. SU APLICACIÓN EN LA DETERMINACIÓN DE LA NULIDAD DE CIERTA VOTACIÓN, CÓMPUTO O ELECCIÓN”.
El principio contenido en la tesis transcrita debe entenderse en el sentido de que, sólo debe decretarse la nulidad de votación recibida en casilla, cuando las causales previstas en la ley se encuentren plenamente probadas y siempre que los errores, inconsistencias, vicios de procedimiento o irregularidades, sean determinantes para el resultado de la votación.
Es decir, que las imperfecciones menores que puedan ocurrir antes, durante la etapa de la jornada electoral o incluso después de terminada ésta, no deben viciar el voto emitido por la mayoría de los electores de una casilla.
Para tal efecto, se debe tener presente que en toda causal de nulidad de votación recibida en casilla está previsto el elemento determinante, sólo que en algunos supuestos, éste se encuentra regulado de manera expresa, como es el caso de las causales de nulidad de votación recibida en casilla, previstas en los incisos f), g), i), j) y k), del artículo 75 de la ley adjetiva de la materia; en tanto que en otras causales de nulidad de votación, dicho requisito está implícito, como ocurre con las reguladas en los incisos a), b), c), d), e) y h), del mismo precepto.
Esta diferencia no impide que, en el último caso, no se deba tomar en cuenta ese elemento, puesto que su referencia expresa o implícita repercute únicamente en la carga de la prueba.
Así, tratándose de las primeras, para declarar la nulidad de la votación recibida en casilla, se deben acreditar los supuestos normativos que integran la causal respectiva, pero además, será necesario valorar los errores, inconsistencias o irregularidades, con el objeto de ponderar si son o no determinantes para el resultado de la votación; mientras que en las segundas, existe una presunción iuris tantum de que las respectivas causas que provocan la sanción anulatoria, son determinantes para el resultado de la votación, salvo prueba en contrario.
Por ello, en el caso de que se acrediten los extremos de los supuestos que integran las causales de nulidad de votación recibida en casilla a que se refieren los incisos a), b), c), d), e) y h), del precepto legal citado, se estima que la irregularidad no será determinante para el resultado de la votación, cuando de las constancias de autos, se acredite que no se vulneraron los principios tutelados por la respectiva hipótesis normativa.
Tal criterio se sostiene por la Sala Superior en la tesis de jurisprudencia 13/2000, cuyo rubro dice: “NULIDAD DE SUFRAGIOS RECIBIDOS EN UNA CASILLA. LA IRREGULARIDAD EN QUE SE SUSTENTE SIEMPRE DEBE SER DETERMINANTE PARA EL RESULTADO DE LA VOTACIÓN, AUN CUANDO EN LA HIPÓTESIS RESPECTIVA, TAL ELEMENTO NO SE MENCIONE EXPRESAMENTE (Legislación del Estado de México y similares)”.
Una vez puntualizado lo anterior, se estima conveniente precisar el marco normativo en que se sustenta la causal de nulidad cuya actualización se reclama.
Por mandato constitucional y legal, las mesas directivas de casilla son los órganos electorales formados por ciudadanos a quienes, el día de la jornada electoral, corresponde asegurar que la recepción del voto esté revestida de las características de certeza y legalidad; asimismo, son responsables de respetar y hacer respetar que el voto de los electores sea universal, libre, secreto, directo, personal e intransferible, encontrándose facultadas para recibir la votación y realizar el escrutinio y cómputo en cada una de las casillas.
En cuanto a su integración, atento a lo previsto en el artículo 82, apartado 1, de la Ley General de Instituciones y Procedimientos Electorales, señala que las mesas directivas de casillas se conforman por un presidente, un secretario, dos escrutadores y tres suplentes generales, quienes de acuerdo con lo previsto en el artículo 83, de la misma párrafo 1, inciso a) de dicha Ley, deberán ser ciudadanos mexicanos por nacimiento, no haber adquirido otra nacionalidad y ser residentes en la sección electoral que comprenda a la casilla.
Con el propósito de garantizar la actuación imparcial y objetiva de los miembros del órgano electoral, la legislación sustantiva contempla dos procedimientos para la designación de sus integrantes: el primero para realizarse durante la etapa de preparación de la elección, y el segundo, que se implementa el día de la jornada electoral y tiene como fin suplir las ausencias de los ciudadanos designados y dar transparencia al procedimiento de integración de las mesas directivas de casilla. Además, se establecen las funciones que corresponden a cada uno de los integrantes de las mesas directivas de casilla.
Acorde con lo anterior, los ciudadanos designados en la etapa preparatoria de la elección deberán seleccionarse mediante el procedimiento que comprende, fundamentalmente, una doble insaculación y un curso de capacitación.
Sin embargo, ante el hecho público y notorio de que los ciudadanos originalmente designados incumplan con sus obligaciones y no acudan el día de la jornada electoral a desempeñar sus funciones como miembros de las mesas directivas de casilla, y en el supuesto de que ésta no se instale a las 8:15 horas, con el objeto de asegurar la recepción de la votación, el legislador federal en el artículo 274 de la misma Ley, establece el procedimiento que debe seguirse el día de la jornada electoral para sustituir a los funcionarios de casilla.
Empero se advierte que, toda sustitución de funcionarios debe recaer en electores que se encuentren en la casilla para emitir su voto; y que en ningún caso podrán recaer los nombramientos en los representantes de los partidos políticos, atento a lo previsto en el párrafo 3, del artículo 274 en comento.
De una interpretación armónica de los preceptos señalados, este órgano jurisdiccional considera que el supuesto de nulidad de votación recibida en casilla que se analiza protege el valor de certeza que debe existir en la recepción de la votación por parte de las personas u órganos facultados por la ley. Este valor se vulnera: a) cuando la mesa directiva de casilla se integra por funcionarios que carecen de las facultades legales para ello; y, b) cuando la mesa directiva de casilla como órgano electoral no se integra con todos los funcionarios designados, por lo que en este caso, tienen relevancia las funciones de carácter autónomo, independiente, indispensables y necesarias, que realiza cada funcionario, así como la plena colaboración entre éstos, con la finalidad de que exista certeza en la recepción del sufragio.
Ahora bien, de conformidad con lo previsto en el artículo 75, párrafo 1, inciso e), de la Ley General del Sistema de Medios de Impugnación en Materia Electoral, la votación recibida en una casilla será nula, cuando se acredite el supuesto normativo, consistente en que la votación se hubiese recibido por personas u órganos distintos a los facultados.
En tal virtud, este órgano jurisdiccional considera que la causal invocada debe analizarse atendiendo a la coincidencia plena que debe existir en los nombres de los ciudadanos que fueron designados funcionarios de las mesas directivas de casillas, de acuerdo con los datos asentados en la lista de integración y ubicación de casillas -encarte-, los anotados en las actas de la jornada electoral y, en su caso, los que aparezcan en las actas de escrutinio y cómputo.
Con el objeto de determinar si se actualiza o no la violación alegada, a continuación se presenta un cuadro en cuya primera columna se identifica la casilla de que se trata; en la segunda, los nombres de las personas facultadas para actuar en la casilla y sus cargos, según la publicación de las listas de integración de mesas directivas de casilla citadas; en la tercera, los nombres de los funcionarios que integraron la casilla y los cargos que ocuparon, de acuerdo con lo asentado en las correspondientes actas de la jornada electoral o de escrutinio y cómputo y, por último, las observaciones sobre las situaciones que se deriven de la comparación entre los distintos rubros del propio cuadro:

Señalado lo anterior, cabe puntualizar que para que los órganos jurisdiccionales se encuentren en posibilidad de realizar el análisis de los hechos aducidos a la luz de la causal de nulidad de votación recibida en casilla, prevista en el artículo 75, apartado 1, inciso e), de la Ley General del Sistema de Medios de Impugnación en Materia Electoral, relacionada con recibir la votación por personas y órganos no designados por los Consejos Distritales, es necesario que los impetrantes en su escrito demanda precisen casilla, cargo y nombre de la persona que a su juicio indebidamente integró la mesa directiva de casilla, para que teniendo dichos datos, se esté en posibilidad de verificarlos con las actas, encarte y lista nominal, ya que en caso de no aportarse dichos elementos, no es posible realizar la referida confronta, con los cual el disenso se tornaría inoperante.
A) Con relación a las casillas 3166C1, 3167B, 3167C1, 3168B, 3171B, 3171C1, 3173B, 3173C1, 3174C1, 3176B, 3176C3, 3179B, 3179C1, 3179C2, 3180B, 3195B, 3242B, 3242C2, 3243B, 3244C1, 3245C2 y 3477B, del cuadro que se inserta, se aprecia que los funcionarios que se cuestionan, fueron designados por el Consejo Distrital para fungir como tales el día de jornada electoral, independientemente de que se trate de suplentes, o que hayan realizado una función diversa a la originalmente encomendada.
Efectivamente, cabe destacar que la figura de los funcionarios suplentes generales, tiene por objeto reemplazar a los funcionarios titulares que por alguna causa no se presenten a cumplir con su obligación ciudadana de formar parte de las mesas directivas de casilla, por lo que al darse esta circunstancia, dichos puestos deben ser ocupados por los suplentes. En consecuencia, la sustitución de funcionarios titulares por suplentes, no actualiza la causal de nulidad de votación recibida en casilla, toda vez que estos ciudadanos fueron insaculados, capacitados y designados por su idoneidad para fungir como tales el día de la jornada electoral, con lo que se garantiza el debido desarrollo de la jornada electoral.
En tal virtud, es evidente que la sustitución de funcionarios en las casillas apuntadas, no lesiona los intereses del partido político actor, ni vulnera el principio de certeza de la recepción de la votación, al haberse recepcionado ésta, por personas designadas por el Consejo Distrital y, en consecuencia, al no actualizarse los supuestos normativos de la causal de nulidad de votación recibida en casilla prevista en el artículo 75, párrafo 1, inciso e), de la Ley General del Sistema de Medios de Impugnación en Materia Electoral, resultan infundados los agravios aducidos por el impugnante respecto de dichas casillas.
B) Respecto de las mesas receptoras de la votación 3163B, 3163C1, 3165B, 3166B, 3169B, 3170B, 3172C1, 3175B, 3175C1, 3175C2, 3176C1, 3176C4, 3180C1, 3181B, 3184B, 3185B, 3185C1, 3186C1, 3187B, 3188C1, 3189B, 3192C1, 3194C1, 3195C1, 3195C2, 3196B, 3197B, 3197C1, 3198B, 3199B, 3200C1, 3202C1, 3208B, 3212C1, 3212C2, 3213C1, 3213C2, 3214C4, 3215B, 3216C1, 3239C1, 3240B, 3244B, 3246B, 3251C1, 3254C2, 3258B, 3261C1, 3262B, 3262C1, 3267B, 3268B, 3269C2, 3272B, 3282C1, 3283C1, 3284B, 3284C1, 3286B, 3286C3, 3287C1, 3288C2, 3289B, 3289C2, 3290B, 3290C1, 3292B, 3296C1, 3297C2, 3301C2, 3314C1, 3347B, 3347C1, 3351C2, 3480C2, 3481B y 3481C2, se aprecia que los funcionarios de la mesa directiva que a juicio del partido inconforme, actuaron indebidamente el día de la jornada electoral, y que se puntualizan en el cuadro que se inserta en líneas precedentes, en algunos casos no fueron los originalmente designados por el Consejo Distrital.
No obstante ello, debe considerarse que cuando no se presenten los ciudadanos que fueron designados por la autoridad administrativa electoral, para recibir la votación en las mesas directivas de casilla, se faculta al presidente de la misma para que realice las habilitaciones de entre los electores que se encuentren formados en espera de emitir su voto en la casilla correspondiente.
La única limitante que establece la propia ley, para la sustitución de los funcionarios, consiste en que los nombramientos deberán recaer en ciudadanos que se encuentren en la casilla para emitir su voto, esto es, que sean residentes en la sección electoral que comprenda la casilla y que no sean representantes de los partidos políticos o coaliciones.
Como se aprecia de lo anterior, el legislador estableció una norma de excepción, a efecto de que el día de la jornada electoral, si no se presenta alguno o algunos de los funcionarios de casilla, ésta se instale, funcione y reciba el voto de los electores, fijando las reglas para que se instalen las casillas en las que ocurra tal ausencia, estimando que no es posible cumplir con las formalidades de designación establecidas por el sistema ordinario, ni tampoco recurrir a ciudadanos que fueron capacitados, doblemente insaculados y designados para desempeñar las funciones en las casillas.
El criterio anterior, encuentra sustento en la tesis XIX/97, emitida por esta Sala Superior de rubro: “SUSTITUCIÓN DE FUNCIONARIOS EN CASILLAS. DEBE HACERSE CON PERSONAS INSCRITAS EN LA LISTA NOMINAL.
Entonces, el hecho de que ciudadanos que no fueron designados previamente por el Consejo Distrital, actúen como funcionarios de casilla, no es motivo suficiente para acreditar que la votación se recibió por un órgano o personas distintas a las facultadas por el código sustantivo electoral, pues en todo caso, la sustitución estuvo apegada a la normatividad vigente.
Empero, si se demuestra que las sustituciones se realizaron con personas que no están incluidas en el listado nominal de la sección, o bien son representantes de los partidos políticos o coaliciones, se tiene por acreditada la causal de nulidad que se invoca, pues con ello se pondría en entredicho el apego irrestricto a los principios de legalidad, certeza e imparcialidad del órgano receptor de la votación.
De esta manera, en las casillas que se precisan, se tiene que los funcionarios que se mencionan en el cuadro que se inserta, sí fueron los designados por el Consejo Distrital y, en aquéllos casos que no fue así, se encuentra que las sustituciones se hicieron con electores de la sección correspondiente, cuyos nombres se encontraban incluidos en el listado de las casillas impugnadas, por lo que es evidente que no se afecta la certeza de la votación recibida, pues la sustitución de los funcionarios se hizo en los términos que señala la ley.
Consecuentemente, al no acreditarse los supuestos normativos de la causal de nulidad de votación recibida en casilla prevista en el artículo 75, párrafo 1, inciso e), de la Ley General del Sistema de Medios de Impugnación en Materia Electoral, resultan infundados los agravios hechos valer en relación a las casillas cuya votación fue impugnada por dicho supuesto.
C) Por lo que hace a las casillas 3164B y 3282B, los disensos planteados resultan inoperantes. Esto, ya que partido actor en el cuadro que inserta en su escrito de demanda, sólo menciona “ESCRUTADOR 2: EN BLANCO”, sin formular una alegación individualizada tendente a evidenciar que en las casillas en comento, se recibió la votación por personas no autorizadas por la Ley General de Instituciones y Procedimientos Electorales.
D) La misma calificativa de inoperante acontece respecto de las casillas 3164C1, 3198B, 3204C1, 3210B, 3251B, 3268C1, 3285C1, 3290C1 y 3286C3, respecto a los cargos que el recurrente menciona en su demanda de inconformidad, pues sólo se limita a mencionar “ILEGIBLE” siendo que dicha manifestación general, no constituye propiamente una hipótesis de nulidad de votación recibida en casilla, de las sancionables en el artículo 75, apartado 1, de la Ley General del Sistema de Medios de Impugnación en Materia Electoral.
E) En relación a las casillas 3208C1, 3213B, 3249C1, 3260C1, 3264B, 3265B, 3278C2, 3287B y 3330B, respecto de las cuales el partido actor en su demanda, hace valer que determinadas personas indebidamente fungieron como integrantes de las mesas directivas de casilla, pues no se encuentran inscritas en la lista nominal de la casilla o sección correspondiente, el disenso resulta fundado.
En efecto, la causal de nulidad que se estudia, sanciona aquellas conductas irregulares ocurridas el día de la jornada electoral, consistentes en que la votación sea recibida por personas distintas a las autorizadas por la ley, esto es, que hayan intervenido funcionarios que no fueron autorizados por el Consejo Distrital, por no encontrarse en la lista de ubicación e integración de casillas, no figurar en el acuerdo de sustitución emitido por la autoridad administrativa electoral en caso de existir, o por no ajustarse al procedimiento de sustitución que la ley electoral, que establece que las sustituciones se realizarán, en principio, con los suplentes, y posteriormente, con los electores que se encuentren en la casilla en espera de votar, y que deberán estar incluidos en la lista nominal de electores y no ostentar el carácter de representantes de partido político o coalición.
En el caso que se analiza, los ciudadanos que fueron designados para ocupar el cargo de secretario, primero y segundo escrutadores, al no formar parte del listado nominal de la sección, no cumplen con el requisito de referencia, por lo que debe considerarse que la recepción de la votación se hizo por personas distintas a las facultades por la ley.
Sirve de apoyo a lo anterior, la tesis de jurisprudencia 13/2002, sustentada por esta Sala Superior de rubro: “RECEPCIÓN DE LA VOTACIÓN POR PERSONAS U ORGANISMOS DISTINTOS A LOS LEGALMENTE FACULTADOS. LA INTEGRACIÓN DE LA MESA DIRECTIVA DE CASILLA CON UNA PERSONA NO DESIGNADA NI PERTENECIENTE A LA SECCIÓN ELECTORAL, ACTUALIZA LA CAUSAL DE NULIDAD DE VOTACIÓN (Legislación de Baja California Sur y similares).”
En consecuencia, al actualizarse la causal de nulidad prevista en el artículo 75, párrafo 1, inciso e), de la Ley General del Sistema de Medios de Impugnación en Materia Electoral, que hizo valer el partido recurrente en torno a dichas casillas, debe decretarse su nulidad.
En atención a lo razonado, ante lo fundado de algunas de los agravios planteados por el partido recurrente, deben modificarse los resultados consignados en el acta de cómputo distrital de la elección de diputados para integrar la Asamblea Constituyente, correspondiente al Consejo Distrital del Instituto Nacional Electoral correspondiente al Distrito Electoral Federal 16 de la Ciudad de México, con sede en Álvaro Obregón.
CUARTO. Efectos. Al haberse decretado la nulidad de la votación recibida en las casillas 3208C1, 3213B, 3249C1, 3260C1, 3264B, 3265B, 3278C2, 3287B y 3330B, lo conducente es realizar la modificación del cómputo distrital de la elección de diputados para integrar la Asamblea Constituyente, respecto al Consejo Distrital del Instituto Nacional Electoral correspondiente al Distrito Electoral Federal Dieciséis (16) de la Ciudad de México, con sede en Álvaro Obregón, en los términos siguientes:

Por lo expuesto, se
RESUELVE:
PRIMERO.- Se modifican los resultados consignados en el acta de cómputo distrital de la elección de diputados para integrar la Asamblea Constituyente de la Ciudad de México, correspondiente al Distrito Electoral Federal Dieciséis (16) de la Ciudad de México, en términos del considerando último de esta sentencia.
SEGUNDO.- Dese vista con la copia certificada de esta sentencia al Consejo General de Instituto Nacional Electoral, para los efectos legales conducentes.
NOTIFÍQUESE; como corresponda.
En su oportunidad, devuélvanse las constancias que correspondan y, acto seguido, archívese el expediente como asunto total y definitivamente concluido.
